Your usage of this “Vista Vacation” agency website in order to purchase Travel Services from Suppliers is permitted only on the following terms and conditions. These include waivers of rights and claims, indemnities and limitations of liability. They also include the terms and conditions of the Tour Operator or other Supplier that you may select. If you do not agree with any part of the following you may not conclude your transaction on this website.
Interpretation
In these terms and conditions the following words (in the singular or plural) shall bear the meanings ascribed to them unless the context clearly indicates to the contrary –
“Agency” means “Vista Vacation”, whose website you have accessed.
“Content Provider” means any person who inserts or provides information for use on this website;
“Suppliers” means the tour operators, airlines or other suppliers of Travel Services or any other product offered from time to time on the Website;
“Travel Documents” means documents required for travel and includes, without limitation, current passports, visas, landed immigrant cards, pardons, permissions and notarised parental consents for minors travelling alone or with only one parent;
“Travel Services” means travel related services such as air, ground and sea transportation, hotel and other accommodation, tours, meals, entertainment and recreational services and insurance products;
No Liability for Contents
Much of the information published on this website is obtained from Suppliers and Content Providers. Vista Vacation does not endorse any advertised Travel Service and does not warrant that the information on this website is accurate. In addition Vista Vacation does not warrant any information provided by the Agency orally or otherwise in connection with any Travel Service. Travel Services listed on this website are provided “as is” without any warranty or representation, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose. Vista Vacation has no liability for typographical and other errors and inaccuracies contained in this website including any errors in pricing. Vista Vacation shall have the right to correct any errors or inaccuracies at any time before or after your transaction without incurring any liability to you.
Your Contract is with the Supplier
In offering the Travel Services on this website, Vista Vacation acts as the agent for, or intermediary in respect of, the Suppliers. Your contract for the supply of the Travel Services selected by you is directly with the Suppliers of the said Travel Services and Vista Vacation Agency is not a party to that contract. As the Suppliers control the delivery of the Travel Services Vista Vacation Agency does not warrant the delivery or the quality of any Travel Service. Vista Vacation Agency also does not warrant the financial position of any Supplier or its ability to provide any Travel Service purchased by you.
You agree that Vista Vacation Agency will not be liable to you or any other person for any refund, loss, damage, delay or injury resulting from the failure of any Supplier to provide any Travel Service to you for any breach of contract or any intentional or careless act or omission by any Supplier of any Travel Service.
Suppliers’ Terms and Conditions apply to your Contract
The Suppliers’ terms and conditions apply to your contract for the supply of Travel Services as between you and the applicable Supplier.
By accepting our terms and conditions you will be deemed to have identified the Supplier or Suppliers of the Travel Services selected by you, to have read and understood their terms and conditions and to be fully bound by the said terms and conditions.
Travel Documents are Required
You acknowledge that you will require Travel Documents for any trip booked by you. If you do not have the required Travel Documents you may be denied boarding or face other complications with consequent forfeiture of the payments made by you on the Travel Services and other losses. You accept full responsibility for obtaining the necessary Travel Documents. By proceeding with your transaction you warrant that you have fully identified the Travel Documents that will be required for the Travel Services you have selected and are satisfied that you already have these or will obtain them well before your departure date.
Travel Companions
The terms, conditions and waivers of rights and claims referred to in this Notice will also apply to your travel companions or any other person for whom you may have requested Travel Services. You agree to convey the provisions of these Terms and Conditions to them promptly, warrant to Vista Vacation Agency that they, their heirs and assigns will consider themselves duly notified and bound by the provisions, and indemnify Vista Vacation Agency against any claims by them in which they, their heirs or assigns allege that they are not so bound. Extension to Agency employees and others The exclusions of liability, indemnities and waivers of rights and claims referred to in these terms and conditions will also apply to and be for the benefit of employees, officers, directors and agents of the Agency.
Lawful Use
By proceeding with your transaction on this website you warrant and represent that you are over the age of 18 years and otherwise able to enter into a binding contract to purchase Travel Services. You also warrant that the reservation or purchase you have made is a legitimate reservation for you or other persons for whom you are legally authorised to act. You also warrant that your use of this website is lawful and in accordance with these terms and conditions and those of the Suppliers.
Use of Information
Subject to the “Vista Vacation AGENCY” Privacy Policy, you expressly agree that Vista Vacation Agency may send newsletters or advertisements to you by e-mail, facsimile or mail.
Applicable Law and Severability
The agreement between you and Vista Vacation Agency is governed by and construed in accordance with the laws of the Province the agency is located in. You hereby consent to the exclusive jurisdiction and venue of the courts in that Province in all disputes arising between you and Vista Vacation Agency. If any provision of this agreement between you and Vista Vacation Agency is found to be unlawful, void or unenforceable, that provision shall be severed from the said agreement and will not affect the validity or enforceability of any of the remaining provisions. The headings of the paragraphs above are for reference only and shall not be used in the interpretation of these terms and conditions.
